Public Comment on Administrative Rules Changes

 

The State Library Commission is seeking public comment on the following proposed actions. The deadline for public comment is December 1, 2023 at noon. The Commission will discuss and take action on these proposed new rules and rules changes at their meeting on December 6, 2023. Full text of the proposed actions may be found here:

 

10-102-2301 (Montana State Library) Notice of Public Hearing on Proposed Adoption, Amendment, and Repeal

 

1. Proposed changes to the public library standards: 

 

Create New Rule I Definitions: The definitions are proposed as a new rule as they apply to the chapter rather than the specific rule. These definitions align the rules with statutory changes.
 

 

Amend 10.102.1158 (7) Library Board, Governance, and Working with the Director: This amendment is proposed to clarify public library standards for securing financial resources for the operation of public libraries. 

 

Amendment of administrative rule 10.102.1158 (1) and 10.102.4003: These amendments are proposed to update the language of the ARM to reflect changes to MCA 22-1-327 in the 2023 Legislative Session to include accredited tribal college libraries. 

 

Amendment to 10.102.1160 Personnel: This amendment to remove the requirement for directors of libraries that serve over 25,000 people have a Master in Library Science or equivalent degree is proposed to reflect the Commission’s opinion that local boards should be given responsibility to set library director qualifications as the size of the community may require a different skillset or knowledge base for the library director.

2. New Subchapter Montana Real Time Network Rules: 

 

These rules are required by statute and necessary to implement a subscription rate to fund the Montana Real Time Network.

3. Amendments to 10.102.91: Montana Geospatial Information Act. 

 
These amendments are proposed to update the language of the ARM to reflect changes to MCA 90-1-401 through 90-1-413 in the 2023 Legislative Session.
